These Terms of Use govern the provision and use of the website and platform offered by Aepsy for the mediation of psychological service providers. These Terms of Use may be supplemented by special terms. Special terms take precedence over these Terms of Use. The current versions of these Terms of Use and the Privacy Policy apply.

Aepsy provides the website and the platform solely on the condition that the user unconditionally agrees to these Terms of Use. If you do not agree with these Terms of Use, you may not access the website or use the platform. By accessing the website and using the platform, you confirm that you have read and understood these Terms of Use in full and that you fully agree to them.

1. Definitions

Website: The website under the domain www.aepsy.com and all its subdomains.
Aepsy: Aepsy AG, headquartered in Zurich.
Platform: All services offered by Aepsy for the mediation of psychological service providers, including the website and the Aepsy app.
User: Individuals who access the website and/or use the platform.
Psychological providers: The psychotherapists (“therapists”) and psychologists (“coaches”) listed on the website and platform.
Consultation session: The psychological treatment agreed upon through the platform by psychotherapists (“therapy”) or psychologists (“psychological coaching”).

2. Platform

2.1 Scope

The platform is intended to connect users with psychological providers and facilitate the implementation of consultation sessions:

  • The user can register, create an account, describe symptoms, and provide additional information. Based on this information, one or more providers may be suggested to schedule a consultation session.
  • The user can view provider profiles, search for additional providers, and book an initial free phone call and/or a first paid session.
  • The user can schedule a session with the provider of their choice, which may take place online or in person depending on availability. Aepsy may provide tools such as (video) telephony or chat functions to facilitate the session. Providers may contact users they have been suggested to.
  • The user has access to a dashboard to communicate with providers and manage appointments and their user account.
  • Aepsy may provide content on psychological topics for informational purposes only. These do not replace professional advice from a qualified expert.

The platform is strictly limited to the services listed above. The execution of consultation sessions is not part of the platform and is subject to a separate contract between provider and user. Aepsy acts solely as intermediary and support, offering no therapeutic or medical services.

2.2 Compensation

The platform is generally offered free of charge to users.

However, users are aware that consultation sessions are charged by the psychological provider. Each provider sets their own pricing. Aepsy strives to present this as transparently as possible before a session is booked. Users are solely responsible for ensuring they can pay and for checking whether insurance will cover the costs.

Aepsy may offer premium membership plans, including those in cooperation with third parties. Some plans may have specific terms disclosed during registration or through notifications.

Aepsy may charge fees for the use of the platform by the user. These fees will be displayed to the user before booking an appointment or service through the Aepsy platform. Fees may include, among other things, compensation for the use of the platform, costs for payment transactions and third-party software used for appointment reminders (e.g. SMS notifications), as well as charges for late cancellations of appointments ("No-Show Fees" equal to the full cost of the counseling session, see section 3 below).

Users can pay for certain sessions through the platform using available payment methods. The user acknowledges that payments are processed by external payment service providers. In this context, payment data (especially credit card information) is stored and processed directly by the respective third-party provider. Only the terms and privacy policies of the respective payment provider apply. Aepsy assumes no responsibility for the processing of payment data by third-party providers.

Aepsy has the right to directly charge certain fees (e.g. collection of the “No-Show Fee” in accordance with section 3) to the user's chosen payment method.

3. Obligations of the User

Users are obliged to provide accurate and truthful information during registration and when scheduling sessions.

Users acknowledge that booking a session is binding, and any absence must be reported in advance to the provider. Users bear full responsibility for any financial or non-financial consequences arising from a no-show or failure to properly cancel or reschedule.

Sessions may be canceled free of charge up to 24 hours in advance. Fees paid will be refunded. For cancellations made less than 24 hours before the session, the full fee will be charged, and refunds are excluded.

Users are expressly reminded that the platform must not be used in life-threatening or emergency situations. In such cases, users must immediately contact appropriate emergency services.

4. Obligations of Psychological Providers

Aepsy offers providers the opportunity to register and, if successfully recruited, conduct consultation sessions via the platform. Upon successful recruitment, a personal profile is created.

Providers agree to provide accurate information during recruitment and accept that their profile may be publicly visible on the website and to registered users, and may also be featured in Aepsy's external communications.

Providers understand and accept that Aepsy acts only as an intermediary and is not responsible for session execution. The treatment relationship is solely between the provider and the user.

Providers guarantee that, at the time of registration and throughout their activity on the platform, they hold the following qualifications:

  • Therapists: A federally recognized or foreign-recognized postgraduate title in psychotherapy under PsyG.
  • Coaches: A recognized psychology degree under PsyG or applicable law in the EU/EFTA country of residence.

Providers must also hold all licenses and authorizations required to deliver their services.

5. Usage Restrictions

In addition to other restrictions stated elsewhere in these Terms, the following actions are strictly prohibited:

  • Copying, reproducing, modifying, selling, sublicensing, or commercializing any part of the platform or website;
  • Removing or altering copyright, trademark, or proprietary notices;
  • Using the platform or website in a way that could harm them;
  • Disrupting access for other users or providers;
  • Using the platform in violation of laws or in a way that may harm others;
  • Deploying harmful software such as viruses or malware;
  • Data mining, scraping, or similar activities;
  • Automated access to the platform (e.g., bots, spiders);
  • Collecting personal data via the platform without permission;
  • Circumventing security or access restrictions;
  • Reverse-engineering any part of the website or its contents.

6. Limitation of Liability

6.1 Scope of Platform Services

Aepsy selects providers with care and verifies their qualifications during recruitment. However, Aepsy cannot guarantee that these qualifications remain valid at all times.

The treatment relationship is exclusively between the provider and the user. Aepsy is not responsible for session quality or outcomes.

Only providers approved by Aepsy are available through the platform. Users are advised to consult external directories if they seek additional providers.

Aepsy is not liable for canceled appointments or provider unavailability. In emergencies, users must not rely on the platform and must contact emergency services.

Some platform functions (e.g., video or chat) are operated by third parties. Aepsy carefully selects these and ensures they take appropriate security measures, but cannot guarantee full security or data transmission reliability.

6.2 Use of the Platform and Website

The platform and website are provided “as is” and “as available.” While Aepsy sources information from reliable providers, it does not guarantee accuracy, completeness, or fitness for a particular purpose.

Users acknowledge that functioning internet access is required. Aepsy does not guarantee uninterrupted access or error-free operation. Aepsy takes appropriate security measures, but cannot ensure absolute data protection.

Aepsy disclaims all liability, to the extent permitted by law, for direct and indirect damages from platform or website use.

Users and providers agree to fully indemnify Aepsy for any claims or damages arising from their violation of these Terms.

6.3 Third-Party Content and Links

The platform and website may contain links to third-party content or websites. Aepsy assumes no responsibility or liability for such content. In case of legal violations, Aepsy will remove affected content as soon as it becomes aware.

7. Intellectual Property

Aepsy (and licensors) retains all rights to content on the website and platform, including structure and layout.

No part of the content (text, graphics, software, etc.) may be altered, copied, transmitted, published, or reused in any way, in whole or in part, without prior written consent.

Users are granted a limited, non-exclusive, non-transferable, non-commercial right to use the platform for internal purposes only.

8. Data Protection, communication

Protecting user privacy is of central importance to Aepsy. Only personal data necessary for platform operation is collected and processed.

Users explicitly consent to the collection and transfer of sensitive health-related data to psychological providers, who are obligated to treat such data confidentially in accordance with their professional duties.

The user consents to Aepsy contacting them via all communication methods they have provided (e.g. email, SMS/phone number, messages on the platform), in particular

  • if a booking has not been fully completed,
  • if their credit is expiring or about to expire,
  • if new information, features or content become available,
  • or for other important reasons related to use of the platform.

Changes to contact details shall apply from the time they are submitted to Aepsy; notifications will be sent to the most recently provided details.

9. Changes

Aepsy may amend these Terms at any time. Changes are published on the website and may also be communicated directly to users and providers.

For existing users and providers, changes are deemed accepted unless objected to within 5 days. Aepsy may exclude users or providers who reject changes.

10. Final Provisions

If any provision is found to be unlawful or unenforceable, the remaining provisions remain in effect.

These Terms are governed by Swiss law, excluding conflict-of-law rules and the CISG. The courts of Zurich, Switzerland have exclusive jurisdiction.
